By using this website, submitting a form, purchasing a product, placing materials in a ResQ collection program, or otherwise interacting with ResQ, you acknowledge that you have read, understood, and agreed to these Terms of Use and our Privacy Policy.

2. Website and Content Use

This website and all text, graphics, branding, layouts, downloads, images, videos, forms, logos, product descriptions, and related content are owned by ResQ or used with permission and are protected by applicable intellectual property laws.

You may use this website only for lawful, legitimate, personal, educational, journalistic, business, or customer purposes related to learning about or engaging with ResQ. You may not copy, reproduce, republish, scrape, modify, exploit, or distribute website content except as allowed by law or with our prior written permission.

3. No Professional or Regulatory Advice

4. Strict Material Restrictions

ResQ’s collection and recycling guidance is limited by chemistry, safety, condition, transportation, and downstream handling requirements. Unless a page, posted sign, written instruction, or approved event specifically says otherwise, ResQ Bins are not for anything except permitted single-use alkaline batteries.

• Do not place defective or damaged batteries in any ResQ Bin. This includes leaking, cracked, punctured, swollen, crushed, burned, overheated, wet, corroded, altered, or otherwise compromised batteries.
• Do not place rechargeable batteries in any ResQ Bin. This includes lithium-ion, lithium metal, nickel-cadmium, nickel-metal hydride, sealed lead-acid, and similar chemistries.
• Do not place electronics or e-waste in any ResQ Bin. Phones, laptops, tablets, chargers, cables, vaping devices, power banks, tools, batteries installed inside products, and similar items must go only through approved e-waste channels.
• Do not use ResQ Bins for commercial, industrial, medical, automotive, or hazardous waste streams unless we expressly approve the material and channel in writing.

You are solely responsible for following all posted instructions, local laws, and safety practices when handling batteries or drop-off materials.

5. Assumption of Risk

Battery handling, storage, transportation, and disposal may involve risks including leakage, fire, explosion, chemical exposure, property damage, and personal injury. By using a ResQ program, website, or collection point, you acknowledge those risks and agree that you are responsible for your own handling, packaging, transport, and compliance unless we explicitly undertake a specific duty in writing.

6. User Representations

You represent and warrant that:

• any information you provide to us is truthful, accurate, and not misleading;
• you will not use this website or our services for unlawful, fraudulent, abusive, or unsafe purposes;
• you will not submit prohibited batteries, e-waste, hazardous materials, or non-approved items into a ResQ Bin or collection program;
• you have the authority to act on behalf of any business, school, or organization you submit through our forms; and
• your use of this website and our services will comply with all applicable laws, regulations, and posted instructions.

7. Orders, Sponsorships, Hosting, and Program Participation

Product purchases, sponsorship arrangements, host relationships, referrals, events, school programs, and other partnerships may be subject to additional terms, instructions, eligibility requirements, pricing terms, disclaimers, and written agreements. In the event of a conflict, the more specific written agreement or program terms will control.

Our website may link to or embed third-party services, including Squarespace-hosted tools, maps, payment processors, forms, videos, downloads, and external websites. We do not control and are not responsible for third-party content, policies, availability, security, products, services, or business practices.

To the fullest extent permitted by law, ResQ’s total aggregate liability for any claim arising out of or relating to these Terms or your use of our website or services will not exceed the greater of one hundred U.S. dollars ($100) or the amount you paid directly to ResQ, if any, for the specific product or service giving rise to the claim.

You agree to defend, indemnify, and hold harmless ResQ and its owners, affiliates, officers, directors, employees, contractors, agents, licensors, successors, and assigns from and against any and all claims, actions, losses, liabilities, damages, judgments, penalties, fines, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to:

• your submission of prohibited, hazardous, defective, leaking, damaged, or unauthorized materials into any ResQ collection channel;
