Battery Recycling Disclaimer

This Battery Recycling Disclaimer governs use of ResQ Sustainability Group LLC’s battery collection, storage, and recycling services, including ResQ Boxes, ResQ Bins, approved drop-off channels, and related guidance or instructions. By using any ResQ collection channel, submitting batteries, or relying on our recycling guidance, you acknowledge and agree to the terms below.
Critical Acceptance Rule
Unless ResQ expressly states otherwise in writing for a specific program or event, ResQ collection channels are only for permitted single-use alkaline household batteries in acceptable condition. No rechargeable batteries, lithium-ion batteries, lithium metal batteries, lead-acid batteries, damaged batteries, leaking batteries, swollen batteries, recalled batteries, e-waste, electronics, or any other materials may be placed into a ResQ Box or ResQ Bin.
1. Scope of Services
ResQ Sustainability Group LLC provides collection and recycling access for specific battery types and, at selected times, may also offer approved e-waste collection events or partner channels. Standard ResQ Boxes and ResQ Bins are intended only for qualifying single-use alkaline household batteries, such as commonly used AAA, AA, C, and D batteries, subject to our posted instructions and acceptance standards.
ResQ does not accept rechargeable batteries, lithium-ion batteries, lithium metal batteries, automotive batteries, industrial batteries, damaged batteries, or general electronics through standard battery bin programs unless ResQ expressly identifies a separate approved collection channel for those materials.
2. Prohibited Materials
The following materials are strictly prohibited from ResQ Boxes and ResQ Bins unless expressly approved by ResQ in writing for a designated event or channel:
- rechargeable batteries of any kind;
- lithium-ion or lithium metal batteries;
- button cells, specialty batteries, battery packs, power banks, or batteries still installed in devices;
- damaged, defective, leaking, swollen, punctured, corroded, burned, hot, wet, recalled, modified, or otherwise compromised batteries;
- lead-acid, automotive, industrial, medical, commercial, or hazardous batteries;
- electronics, chargers, cords, devices, or general e-waste through standard battery-only collection bins.
If you have rechargeable batteries, lithium-based batteries, or e-waste, you must use an approved e-waste drop-off, collection event, or authorized downstream recycling partner designated for those materials.
3. Safety Requirements for Permitted Batteries
To reduce risk and support safe handling, users must follow all posted instructions and applicable guidance when submitting batteries to ResQ. In addition:
- submit only batteries that appear to be ordinary single-use alkaline household batteries in acceptable condition;
- do not submit batteries that are leaking, cracked, bulging, wet, unusually hot, visibly corroded, or otherwise compromised;
- do not force batteries into a bin, container, or opening if they do not fit safely;
- keep prohibited materials out of all ResQ collection channels;
- where safe and practical, users may isolate battery terminals with non-conductive tape, especially when handling uncertain battery types outside the standard alkaline stream.
Even batteries that appear discharged can retain residual energy. Users remain responsible for handling all batteries with care.
4. No Guarantee of Acceptance
ResQ reserves the right to reject, remove, isolate, refuse, or redirect any material submitted to a collection channel if we believe the material is unsafe, prohibited, misidentified, contaminated, non-compliant, or otherwise unsuitable for the intended stream. A collection bin’s availability does not guarantee acceptance of every item presented.
5. Assumption of Risk
Battery handling, transport, storage, and disposal involve inherent risks, including fire, heat generation, explosion, leakage, chemical exposure, contamination, and property damage. By using a ResQ collection channel, you acknowledge these risks and agree that you are solely responsible for your own handling, packaging, transport, and drop-off decisions unless ResQ expressly undertakes a specific duty in writing.
6. Limitation of Liability
To the fullest extent permitted by law, ResQ Sustainability Group LLC and its owners, affiliates, officers, directors, employees, contractors, agents, successors, and assigns will not be liable for any damages, injuries, losses, costs, or claims arising out of or related to:
- submission of prohibited or misidentified materials into a ResQ Box, ResQ Bin, or other collection channel;
- submission of damaged, defective, leaking, swollen, corroded, wet, recalled, or otherwise hazardous batteries;
- failure to follow posted instructions, warnings, labels, or collection requirements;
- user handling, transport, storage, or packaging errors before or during drop-off;
- property damage, personal injury, environmental damage, fire, contamination, or related incidents caused by non-compliant or unsafe materials;
- acts or omissions of third-party hosts, vendors, transporters, recyclers, downstream handlers, or event partners.
7. Indemnification
You agree to defend, indemnify, and hold harmless ResQ Sustainability Group LLC and its owners, affiliates, officers, directors, employees, contractors, agents, successors, and assigns from and against any and all claims, liabilities, damages, penalties, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to:
- your submission of prohibited, hazardous, or non-compliant materials;
- your failure to follow this Disclaimer or posted instructions;
- your misuse of any ResQ collection channel, event, program, or guidance;
- your violation of law, regulation, or third-party rights in connection with battery disposal or material submission.
8. No Professional, Safety, or Regulatory Advice
Information on our website or in our materials is provided for general informational purposes only and does not constitute legal, environmental, hazardous waste, transportation, fire safety, engineering, or regulatory compliance advice. You are responsible for determining whether your materials are suitable for a given collection stream and for complying with all applicable laws and local requirements.
9. Governing Law
This Disclaimer shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to conflict of law principles.
