Legal Disclaimer for Battery Recycling Services
ResQ Sustainability Group LLC
Effective Date: May 15, 2025
Introduction
ResQ Sustainability Group LLC (hereinafter referred to as "ResQ"), the parent company of ResQ, provides battery recycling services through its ResQ boxes and ResQ bins. This Legal Disclaimer outlines the scope of our recycling services, safety requirements for battery disposal, and the limitations of our liability. By using our services, you agree to comply with the terms outlined herein.
Scope of Recycling Services
ResQ exclusively accepts single-use alkaline batteries, such as but not limited to AAA, AA, C, and D, for recycling through its ResQ boxes and ResQ bins. We do not accept rechargeable batteries, lithium-ion batteries, or any other battery types. For the recycling of rechargeable or lithium-ion batteries, we strongly recommend utilizing the services of our authorized affiliates. A list of affiliates can be found on our website at www.resqbatteries.com.
Safety Requirements for Single-Use Alkaline Battery Disposal
To ensure safe and proper recycling, users must adhere to the following requirements when disposing of single-use alkaline batteries, such as but not limited to AAA, AA, C, and D, in ResQ boxes or bins:
Discharge Requirement: Single-use alkaline batteries must be fully discharged before disposal to minimize the risk of electrical discharge or heat generation.
Terminal Taping: If possible, the terminals of single-use alkaline batteries should be taped with non-conductive tape to prevent short-circuiting.
Condition of Batteries: Only undamaged single-use alkaline batteries are approved for storage in ResQ boxes and recycling via ResQ bins. Damaged, leaking, or otherwise compromised batteries are strictly prohibited.
Failure to comply with these safety requirements may result in hazards, including but not limited to fire, chemical leakage, or environmental contamination, for which ResQ shall not be held liable.
Future Expansion of Services
ResQ plans to establish high-capacity recycling locations at computer repair and cell phone repair facilities for broader battery recycling options. However, this expansion is not anticipated to be available until 2026. Until such facilities are operational, ResQ’s services remain limited to single-use alkaline battery recycling as described above.
Limitation of Liability
ResQ Sustainability Group LLC, including its subsidiaries, affiliates, officers, directors, employees, and agents, shall not be held liable for any damages, injuries, losses, or claims arising from the use or misuse of ResQ boxes or ResQ bins, including but not limited to:
Improper disposal of non-single-use alkaline batteries (e.g., rechargeable or lithium-ion batteries) in ResQ boxes or bins.
Failure to follow the safety requirements outlined above, including disposal of damaged or undischarged single-use alkaline batteries.
Any environmental, personal, or property damage resulting from user negligence or non-compliance with this disclaimer.
Any incidents occurring during the transportation, storage, or recycling process due to user error.
By using ResQ’s services, you expressly assume all risks associated with battery disposal and agree to indemnify and hold harmless ResQ Sustainability Group LLC from any and all liability, claims, demands, or actions arising from your use of our services.
Governing Law
This disclaimer shall be governed by and construed in accordance with the laws of the state in which ResQ Sustainability Group LLC is incorporated, without regard to its conflict of law principles.
